1. In this Appendix 1 and in Appendix 2 (GDPR – Data Processing Agreement):

1. “Customer Personal Data” means any personal data which METAAGROW (or its sub-processors) processes on your behalf as a processor in the course of providing Services.

2. “EU Data Protection Laws” means the EU General Data Protection Regulation (GDPR) and any national laws for implementation of the same, as well as regulations and supplementary legislations thereunder, as amended from time to time; in the relevant jurisdiction.

3. “Services” means any services provided by Metaagrow to you, the customer, end user or data subject.

4. “Security Incident” means a breach of METAAGROW’s security leading to the accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, compromise of or access to, Customer Personal Data.

5. “Personal data, consent, Data Controller, Data Processor, Data Subject and Data Processing” these terms shall have the as given to it under the GDPR

2. METAAGROW is the Data Processor, processing data on behalf of and as per the instructions of the Customer. The Customer (which includes subscribers of the paid as well as No Charge Services) is the Data Controller in respect of personal data, which is uploaded by the employees and End Users accessing the website/ application and the services offered by Metaagrow through the Customer. Therefore, the Customer shall be responsible and bound by the obligations of the Data Controller as prescribed under the GDPR. More specifically, it is the Customer’s responsibility to ensure that in accordance with relevant Data Protection Laws:

– There is a lawful basis for the collection and processing of personal data; and

– The Customer has provided an appropriate privacy policy to the End Users and other data subjects.

3. Metaagrow is only a Data Processor and shall only process the Personal Data on behalf of the Customer in accordance with the Customer’ instructions as set out in the Data Processing Agreement between the Customer and METAAGROW.
