This Privacy Policy (the “Policy”) describes the policy regarding information that we gather from visitors, users, subscribers and others who access or use the website, the mobile application and/ or the Services offered through the website or the application (“Users,” “you,” accordingly “your” shall be interpreted referring to the User), how we use and disclose such information, and the steps we take to protect such information. This Policy is incorporated into and is subject to the Metaagrow Terms of Use. When you share information with us, for example by creating an account with us, we can make the Services even better to help you connect with people or to make sharing with others quicker and easier. A. Information We Collect
  1. Personal Information

    While using the Services, we will ask you to provide us with certain personally identifiable information that can be used to contact or identify you (“Personal Information”). The term "personal data" designates all data that allows an individual to be identified directly or indirectly, which corresponds in particular to your surname, first / given names, postal and e-mail addresses, telephone, mobile or any other contact numbers, country, time zone, and data relating to your transactions on Metaagrow, the name of your company, your job title and areas of expertise, data from recordings of calls with our teams (for example: the content, dates and time of the calls), as well as any other information you provide to us about yourself.

    You may provide us with Personal Information when you register for an account, use the Services, make a purchase, contact customer support, sign up for marketing material, or otherwise communicate with us. Please note that if you choose not to share certain Personal Information with us, or refuse certain permissions, we might not be able to provide you certain parts of the Services. Additionally, other Users (such as within your company) may give us your Personal Information, such as when a User invites you to join the Services or create an account.     Responsibility for the processing of your personal data lies with Metaagrow or third party that Metaagrow engages with for bettering the Services offered. Responsibility for the collecting of your personal data lies with the Customer of Metaagrow through which you are accessing the services offered by Metaagrow.

  3. Usage Information

    We collect information about how you interact with the Services, such as address of a referring website, activity on our website, access dates and times, information related to your transactions on the Services, and other system activity. We may collect certain information by automated means using technologies such as cookies, web beacons or pixels. In many cases the information we collect using cookies and other tools is only used in a non- identifiable manner without reference to Personal Information. For example, we may use information we collect to better understand website traffic patterns and to optimize your experience. We track users’ use of the Services, but we do not track users across third party websites. We do not process or respond to web browsers’ “do not track” signals or other similar transmissions that indicate a request to disable online tracking of users who visit or use the Services.

    • To manage your complaints/grievances through our third party ticketing software to ensure faster resolution time; and
    • To manage your account through our third party payment gateway software to ensure reminders, account history, payments history etc.

    We shall inform you, when requesting your personal data, if certain information must be provided or if it is optional. Please note that if you choose not to share certain Personal Information with us, or refuse certain contact permissions, we might not be able to provide certain parts of the Services.

    We also inform you that we are likely to collect your data indirectly and thus enabling you to use our Services, or from other users of our services.

    In this respect, you are hereby informed that we may reuse your personal data that is stored in the address book of another user of our services who has expressly authorized us to access their contacts to put you in contact with each other.

    • In connection with, or during negotiations of, any merger, sale of company assets, financing or acquisition, or in any other situation where information may be disclosed or transferred as one of the business assets of Metaagrow.

We are not responsible for the practices employed by websites or services linked to or from neither the Services, nor the information or content provided to or contained therein. Please remember that when you use a link to go from the Services to another website, this Policy does not apply to those third-party websites or services. Your browsing and interaction on any third-party website or service, including those that have a link on the Services, are subject to that third party’s own rules and policies. Please read those rules and policies before proceeding.

    Your personal data will not be assigned to, rented to or exchanged with any third party, with the exception of our business partners to enhance the experience of the services offered to you by Metaagrow.

c. How We Protect Your Information

We will only keep your Personal Information for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. We may also retain and use your Personal Information for as long as necessary to resolve disputes and/or enforce our rights. Where we rely on your consent to process your Personal Information, you have the right to decline consent and/or if provided, to withdraw consent at any time. This will not affect the lawfulness of processing prior to the withdrawal of your consent. Additionally, in some circumstances you can ask us to delete your Personal Information.

We limit access to Personal Information to our employees, agents, contractors, and other third parties who have a business need to know. They will only process Personal Information on our instructions and they are subject to a duty of confidentiality.   1. International Transfers

    European Users: If you choose to use the Services from the EU or other regions of the world outside India, with laws governing data collection and use that may differ from Indian law, please note that you are choosing to provide personal information to use and allowing us to transfer your Personal Information outside of those regions to India (or any other country where we operate or may have co- locations) for storage and processing. When you provide Personal Information, it may be sent to servers located in India and other countries around the world. By providing any information, including Personal Information, on or to the Services, you consent to such transfer, storage, and processing. As described in this Policy, we may share Personal Information with third parties and may be required to disclose information in response to lawful requests by public authorities, including meeting national security or law enforcement requirements.

    The legal grounds for our processing your Personal Information for the purposes in this Policy are as follows:

    • The processing is necessary for us to comply with our legal or regulatory obligations
    • The processing is in our legitimate interest as a provider of the Services (for example, to protect the security and integrity of our systems and to provide you with customer service and the core functionality of the Services)

  2. Data retention period
    • Regarding data relating to customer and prospect management:

      Your personal data shall not be retained any longer than is strictly necessary for the management of our business with you. However, data proving the existence of a right or a contract must be kept in order to adhere to legal obligations and shall be held for the term stipulated by the applicable law.

      Your personal data will be maintained for a period as reasonably required under the applicable laws, after exit/termination of subscription services.

      Personal data relating to a prospective customer, who is not already a customer, may be held for a period of three (3) years from the moment it is collected or from the last contact with the prospective customer. At the end of this period, we may contact you again in order to find out if you wish to continue to receive commercial solicitation.

    • Regarding user data:

      Your personal data is kept for a period of 3 (three) years from the date of your last use of the application.

    • Regarding bank card data:

      Financial transactions relating to payments for purchases and fees on Metaagrow are entrusted to payment service provider who ensures the smooth processing and security of these transactions.

      For the purposes of the services, the payment service provider may collect and store your personal data relating to your bank card numbers in our name and on our behalf for processing the payments made by you for the Services. We do not have access to and we do not store or process this data. Your banking card's security code or CVV2 code is not stored.

      In any event, data relating to the card (if any collected) may be retained for the purposes of providing proof in the event of a transaction subsequently being contested, in intermediary archives, for the period stipulated under applicable law.

    • Regarding the management of opt-out lists compiled during prospecting activities:

      Information enabling recognition of your right to opt-out is retained for the period stipulated under applicable law following the exercising of your right to opt out.

    • Regarding invoices:

      Invoices are kept for such period so as to comply with our accounting and taxation obligations as stipulated under applicable law.

    • Regarding the management of your requests to exercise your rights under the GDPR:

      Information enabling the management of your requests to exercise your rights under the GDPR will be kept for 3 (three) years from the date of your request.

  3. Data of minors

    We do not knowingly collect, retain or process personal information from children under the age of 18, and no part of our service is intended for children.   4. Accessing and Modifying Your Information

    Metaagrow is very sensitive about your data, and thus ensures it is always saved in cloud by AWS, who uses the maximum data security.

  7. Legal basis for processing your data

    We process your data on the basis of the following legal grounds:

    • Performance of the contract you have entered into with us to use our services on Metaagrow;
    • Our legitimate interest in developing and promoting our business;
    • To enhance our Services to you.
    • Our legitimate interest in training our employees;
    • To comply with the legal and regulatory obligations to which we may be subject.
  8. Rights under GDPR

    We would like to inform you that as a user, you have following rights in respect of your personal data shared with us:

    • Right to access & rectification – you have the right to obtain any data concerning you, via request to use to be sent on email address mentioned below. You also have a right to modify your personal data. Further, you also have the right to rectify or correct any data concerning you, if you believe the information, we have is inaccurate or incomplete, you can do so by getting in touch with the point of contact indicated.
    • Right of erasure – you have the right to request that we erase your personal data, subject to certain conditions.
    • Right of restriction on processing data – you have the right to request to restrict the processing of your data, subject to certain conditions.
